Annotated Safety, Rehabilitation and Compensation Act 1988

The 12th edition of the Annotated Safety, Rehabilitation and Compensation Act 1988 includes: • the Safety, Rehabilitation and Compensation Act 1988 current at 1 February 2023; • annotations of Court and Tribunal decisions to 1 February 2023; • the current Safety, Rehabilitation and Compensation Regulations 2019 and Safety, Rehabilitation and Compensation Directions 2019. The 12th edition contains an up-to-date discussion of recent litigation concerning the SRC Act, including “injury” and “disease” following MRCC v May [2016] HCA 19 and Wuth v Comcare [2022] FCAFC 42, “reasonable administrative action taken in a reasonable manner”, medical treatment, and construction of the approved Guide. It includes a list of all legislative instruments made under the SRC Act, including those regulating the coverageof licensees under the Scheme, and a Legislative Amendment History of the SRC Act. The 12th edition also contains a detailed consideration of military compensation under the Safety, Rehabilitation and Compensation (Defence-related Claims) Act 1988 (DRCA), which commenced on 12 October 2017. This includes commentary and annotation of decisions on elements of the DRCA which differ from the SRC Act, a list of legislative instruments made under the DRCA, and a DRCA Legislative Amendment History.
